About the service
Incentively helps organisations create, control and deliver promotional vouchers, rewards, offers and tickets. These terms apply alongside any order form, subscription terms or data processing agreement.
Business customers
The business account owner confirms that they are authorised to act for the organisation. The organisation is responsible for campaign content, eligibility, uploaded data, reward availability, consumer law, tax, marketing permissions and the conduct of invited team members.
Recipients
A reward is offered by the organisation named on the campaign, not by POP QUEST LTD unless explicitly stated. Eligibility, availability, expiry, redemption and campaign-specific terms are controlled by that organisation. Incentively provides the technology and does not guarantee that every request for a reward will be approved.
Accounts
You must provide accurate information, keep credentials secure and tell us promptly about suspected unauthorised access. Accounts may not be sold, shared improperly or used to impersonate another person or organisation.
Acceptable use
You must not use Incentively for unlawful, misleading, discriminatory, infringing, fraudulent or abusive campaigns, spam, malware, credential harvesting, security bypassing or unauthorised data processing.
Intellectual property
Customers retain rights in their branding, campaign content and data. They grant us the limited rights needed to host, display and process that material. Incentively software, branding and platform materials remain ours or our licensors’.
Availability and changes
We work to keep the service available but do not promise uninterrupted operation. We may maintain, improve or change features, and may suspend activity that creates legal, security or operational risk.
Liability
Nothing excludes liability that cannot legally be excluded. Any additional limitations, fees, renewal and termination terms are set out in the applicable business agreement. Recipients retain their statutory rights.
Governing law
Unless contract-specific terms say otherwise, these terms are governed by the laws of England and Wales and the courts of England and Wales have jurisdiction.
